1. Acceptance of Terms

By accessing or using MTAInstalls services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

2. Description of Service

MTAInstalls provides automated provisioning, configuration, and management of Mail Transfer Agents (MTAs) on your cloud infrastructure. We are an infrastructure deployment service, not an email service provider. Our services include:

• Automated MTA deployment and configuration (KumoMTA and Postfix)
• Cloud infrastructure provisioning and management
• Monitoring and analytics tools for your deployed MTAs
• API access and webhook integrations
• Customer support and documentation

Important: Customers do not send emails through MTAInstalls. All email traffic flows through your own deployed MTA infrastructure that we help you set up and manage.

3. Account Registration

To use our services, you must:

• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Be at least 18 years old or have legal guardian consent

4. Acceptable Use

Important Clarification: MTAInstalls is an infrastructure deployment and management service. We deploy and manage Mail Transfer Agent (MTA) software on your cloud infrastructure. Customers do not submit emails through MTAInstalls - instead, you connect your own applications, websites, or email systems directly to the MTAs we provision for you. We do not handle, route, store, or process any email content whatsoever.

You may use our infrastructure services to:

• Deploy and manage legitimate email infrastructure on your cloud accounts
• Monitor and analyze your MTA performance and delivery metrics
• Integrate with your applications via our API and webhooks
• Configure and maintain secure email infrastructure
• Access deployment logs and system health information

You may NOT use our infrastructure services to:

• Deploy infrastructure with the intent to violate applicable laws
• Circumvent our security measures or access controls
• Violate any cloud provider terms of service
• Infringe on intellectual property rights
• Use our service for cryptocurrency mining or other unauthorized resource-intensive activities
• Attempt to compromise or interfere with our service infrastructure
• Share account credentials or allow unauthorized access
• Reverse engineer or attempt to extract our proprietary deployment methods

Regarding Email Content and Compliance:

• MTAInstalls does not send, receive, store, or process any email content
• All email traffic flows directly through your deployed infrastructure
• You are solely responsible for all emails sent through your deployed MTAs
• You are responsible for compliance with all applicable laws (CAN-SPAM, GDPR, etc.)
• You are responsible for maintaining proper email authentication (SPF, DKIM, DMARC)
• You are responsible for managing IP reputation and deliverability

5. Subscription Plans and Billing

Subscription Terms

• Subscriptions are billed monthly or annually in advance
• Free trials do not require payment information
• Pricing is subject to change with 30 days notice
• Overage charges may apply for usage beyond plan limits

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused services
• Enterprise plans may have different cancellation terms

6. Data and Privacy

• You retain ownership of your data and content
• We may access your data to provide services and support
• You are responsible for backing up your important data
• We implement security measures but cannot guarantee absolute security
• Data processing is governed by our Privacy Policy

7. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance
• Emergency maintenance may occur without notice
• Third-party service outages may affect our services

8. Intellectual Property

• MTAInstalls and our logos are trademarks of Mailqueue LLC
• Our software, documentation, and content are proprietary
• You may not copy, modify, or distribute our intellectual property
• You grant us license to use your feedback for service improvement

9. Third-Party Services

Our services integrate with third-party cloud providers and services. Your use of these services is subject to their respective terms and privacy policies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MTAInstalls is provided "as is" without warranties
• We are not liable for indirect, consequential, or punitive damages
• Our total liability is limited to amounts paid in the last 12 months
• You are responsible for all content sent through your deployed infrastructure
• You are responsible for compliance with applicable laws and regulations
• We are not responsible for third-party cloud provider service failures
• We are not responsible for email delivery, blocking, or reputation issues

11. Indemnification

You agree to indemnify and hold harmless Mailqueue LLC from any claims, damages, or expenses arising from your use of our services or violation of these terms.

12. Termination

We may suspend or terminate your account for:

• Violation of these terms or acceptable use policy
• Non-payment of fees
• Suspected fraudulent or illegal activity
• Extended period of inactivity

13. Governing Law

These terms are governed by the laws of the State of Texas, USA. Any disputes will be resolved in the courts of San Antonio, Texas.

14. Changes to Terms

We may update these terms periodically. Significant changes will be communicated via email or platform notification. Continued use constitutes acceptance of updated terms.
